This session, titled “Neural Frontiers: Brain Health, Data & Human Rights,” brought together leading academics, industry experts, and policy advisors, each bringing deep expertise in neurotechnology innovation, ethics, and policy:
The rapid advancement of neurotechnologies such as invasive and non-invasive BCIs promise revolutionary applications in brain health diagnostics, treatment of neurological disorders, and human augmentation. However, these technologies also raise risks related to mental privacy, cognitive liberty, and the potential for misuse of sensitive brain data.
The panel emphasized that brain data is fundamentally different from other biometric data, requiring tailored regulatory approaches that recognize its intimate connection to personal identity and autonomy.
The discussion underscored the evolving EU regulatory frameworks, including the Medical Device Regulation (MDR) and the General Data Protection Regulation (GDPR), which currently provide partial coverage for neurotechnologies. While MDR governs safety and efficacy of neurodevices, GDPR addresses data protection, yet neither fully encompasses the unique challenges posed by neural data.
One fundamental takeaway from the discussion was the need to raise further awareness on neurotech innovations and products as well as bring clarity at regulatory level.
